Our store is hosted on WIX.com. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
The Agreement Between Us
Please read these Terms and Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. The Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content and to all purchases of goods and services from Waiheke Hamper Co Ltd (we/us). If you do not agree to all the Terms and Conditions of this agreement, then you may not access the website or use any services.
We reserve the right, at our discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes. You can review the most current version of the Terms and Conditions at any time at this page. We will supply goods and services to you on these Terms and Conditions only unless we have expressly agreed in writing to a variation of them.
We remain the owner of the product that we supply to you until we have received payment in full for the product.
All prices are listed in New Zealand dollars and must be paid for in New Zealand dollars at the time of your order. Prices displayed on the website have no GST added as we are not GST registered. Charges for delivery apply where applicable. (view our delivery information here).
No contract for the sale and purchase of products will be formed, or variation or cancellation made, until we confirm acceptance of your order, variation, or cancellation. We reserve the right to remove or edit content or cancel orders at our discretion, but without charge to you.
Products might be subject to variation. If there is an error we will contact you as soon as possible. You will have the option of reconfirming your order at the correct price or cancelling it. If we are unable to reach you, your order for the incorrectly priced item will be cancelled as we are not obliged to honour such orders.
Errors, inaccuracies and Omissions
Occasionally there may be information on our site or in the Service that contains errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, delivery times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on our website is inaccurate at any time without prior notice, including after you have submitted your order. We have made every effort to display as accurately as possible the colours, dimensions, descriptions and images of our products that appear on the site. We reserve the right from time to time to vary the dimensions, specifications, descriptions and quantities of items displayed on our website without prior notice. We reserve the right to substitute items in your order for goods of equal or greater value.
Gift Hampers contain only the items listed. Some products and packaging may vary according to availability. In the event of supply difficulties, Waiheke Hamper Co Ltd will endeavor to supply you with the goods or services ordered, but we will not be liable to any person if we decline to fulfill, discontinue or are unable to fulfill, an order.
We only deliver within New Zealand.
The gift hamper is at your risk as soon as it is delivered to you. Delivery will be deemed to have been made when it is left at the address provided in your order or when a "Card to Call"has been left. We supply reputable products and endeavour to ensure that the products leave us in good condition. We use third parties to deliver our gift hampers so please contact us immediately if it has been damaged in transit.
We will make reasonable endeavors to deliver the products to the address provided in your order within a reasonable time of accepting your order (see our delivery time frames). If you have specified a delivery date, we will do all that we can to deliver the gift hamper by that date but we will not be liable for late delivery. Late delivery does not entitle you to cancel any order or part of any order.
We will re-deliver, replace or refund the product (at our option) if we have incorrectly addressed the delivery but we take no such responsibility if you gave an incorrect or insufficient address, or if there was no delivery due to the premises being unsafe to access.
Delivery of gifts containing alcohol
By New Zealand law we cannot sell or supply alcohol to persons under the age of 18 years. When ordering one of our gifts containing alcohol you are confirming that both you and the recipient are both aged 18 years or over. Gifts containing alcohol will be sent with a 'signature required'. This means someone over 18 must be there to sign for the gift. If there is no one home to receive the parcel a “Card to Call” will be left by the courier with details of how to collect the gift.
If you would prefer to give the courier the authority to leave the parcel without a signature in a safe place, please add these details in the “add a note” section in your cart.
Delivery will be deemed to have been made when it is left at the nominated address or when a "Card to Call" has been left.
Please note alcohol cannot be sold or delivered on Good Friday, Easter Sunday, Christmas Day, or before 1pm on Anzac Day as this is New Zealand law.
Cancellations & Amendments Prior or After Dispatch
Once placed, it may not be possible to prevent an order from being dispatched. Similarly, once dispatched we are unable to stop delivery or cancel the order. If you wish to cancel your order, please contact us on 027 885 1382. We make no guarantees that once placed and paid for, an order can be amended. If you wish to amend an order you must notify us by phone as soon as possible and provided the order has not already been created we will try to amend it. We also reserve the right to cancel or amend your order before the goods are despatched if the goods are no longer in stock.
In the unlikely event that your gift arrives damaged or you are not satisfied with your purchase, please contact us as soon as possible on 027 885 1382 or email and we will arrange for the gift hamper to be returned and either replaced or refunded. Due to the nature of our goods, unfortunately we are unable to refund for ‘change-of-mind’ purchases.
Please ensure any details you provide us with are true, correct, complete and up to date. Inform us immediately of any changes to those details.

You can therefore rest be assured that we take the privacy and security of your payment and personal details very seriously.
